Constitutional Court of Slovenia Again Upholds Our Law Firm’s Arguments in the Field of Real Estate Law

We are pleased to announce that the Cukrov Law Firm has today received a new decision from the Constitutional Court of the Republic of Slovenia, marking our fourth victory this year in the field of real estate law before the Constitutional Court.

In case U-I-269/22-19, the Constitutional Court upheld our legal argument that even constitutional limitations imposed on the drafters of spatial planning acts constitute an exercise of the right to private property under Article 33 of the Constitution of the Republic of Slovenia. This means that landowners must be allowed a legitimate expectation that they will be able to exercise the rights arising from the designated use of their land.
