A few highlights:<\/p>\n<ul>\n<li style=\"text-align: justify;\"><strong>Energy Charter Treaty:<\/strong> Slovenia&#8217;s withdrawal took effect on 14 October 2024, but the 20-year sunset clause could extend protection for qualifying investments to October 2044. As we explain, this is not an unconditional entitlement for every investor or claim.<\/li>\n<li style=\"text-align: justify;\"><strong>Intra-EU investment claims:<\/strong> the 2026 ECT interpretative agreement, which lists Slovenia, reaffirms the absence of consent to intra-EU arbitration. We also explain why the Ascent award of 7 July 2026 should not be labelled an ordinary intra-EU case.<\/li>\n<li style=\"text-align: justify;\"><strong>Emergency relief within days:<\/strong> under the Ljubljana Arbitration Rules, an emergency arbitrator is ordinarily appointed within 48 hours and the order is due within 15 days.<\/li>\n<li style=\"text-align: justify;\"><strong>AI in dispute resolution:<\/strong> Slovenia adopted ZIUDHPUI in 2025 to implement the EU AI Act&#8217;s supervisory framework. There are still no dedicated arbitration AI rules, so we set out the safeguards parties and tribunals should apply now.<\/li>\n<li style=\"text-align: justify;\"><strong>What comes next:<\/strong> from 1 January 2027, the new Courts Act (ZS-1) updates the court-designation rules in the Arbitration Act.
